WAIVER, RELEASE AND INDEMNITY FOR BICYCLES AND SCOOTERS

Swan View Toy Library Waiver, Release and Indemnity for:

Bicycles and Scooters.

All Toy Library members are asked to please read and sign the waiver below, even if your child is currently not old enough to use ride ons.
It is an important requirement from our insurers.

The Swan View Toy Library is pleased to make bicycles and scooters available to its members. As a member of the Service you acknowledge that there are dangers and risks inherent with bicycle and scooter riding to which any child under your supervision may be exposed. The Swan View Toy Library does not provide protective clothing or bicycle helmets and it is your responsibility to ensure that your child wears a helmet at all times and is otherwise appropriately attired when participating in activities with Toy Library assets.

You agree that your child will participate in any activity at your own risk. You also agree to voluntarily assume responsibility for supervising any activity and any injury, death or property damage you or your child may suffer or cause as a result of participating in activity with Swan View Toy Library assets.

To the maximum extent possible at law, you (both in your personal capacity and on behalf of your child) agree to release, hold harmless and indemnify the Swan View Toy Library and its respective officers, volunteers, agents and contractors against all actions, claims, suits, costs, expenses, demands and damages suffered or incurred by the indemnified persons or any one or more of them by reason of, or in respect of, or in any manner whatsoever arising out of, or caused by, your use of the Swan View Toy Library assets or your child`s participation in the activity.

You agree that you are subscribing to the service on the express condition that the Swan View Toy Library:
( a) will, under no circumstances be liable or responsible in any manner whatsoever for any death, loss, accident, damage or injury to you, your child or any of your servants, agents, contractors, visitors or invitees or any other person whatsoever which may happen as a result of your use of the Swan View Toy Library assets or your child participating in any activity; and (b) will not incur or be under any liability whatsoever to you, your child, or to any related party for any loss, damage or injury to or in respect of any of your property or of any related party’s property. The Swan View Toy Library is not liable to you, your child or any related party in respect of any indirect or consequential loss. For the avoidance of doubt, ‘consequential loss’ means loss or damage arising from a breach of contract, tort (including negligence), under statute or any other basis in law or equity of an indirect or consequential nature including, but without limitation, loss of profits, loss of revenue, loss or denial of opportunity, loss of goodwill, loss of business reputation, future reputation or publicity, damage to credit rating and indirect, remote, abnormal or unforeseeable loss, or any similar loss whether or not in the reasonable contemplation of the parties.

Terms & Conditions of Application

Swan View Toy Library is a volunteer run service funded by membership fees and fundraising.

All members are required to contribute to the running of the service by fulfilling 4 roster shifts during their 12-month membership (unless applying for a Non-Duty Membership Type). Children are more than welcome to accompany you to your roster shift.

A 3-month maternity leave is granted to new mums.

From time to time we may have a fundraising or promotional event, we would love it if our members can assist on those days.

A $5 fine will be issued for a missing part of a toy or jigsaw. You will be allowed to renew your toy or jigsaw once to try and locate the missing piece.

If a toy is return broken you will be asked to replace or pay the RRP for a toy or jigsaw if the toy or jigsaw is unusable or made dangerous for others by damage cause during your care.

Fines must be paid with via cash, eftpos or bank transfer at members next 3 week borrowing session or membership will be placed on hold until full payment is made.

Toys are loaned for a 3-week period. Failure to return toys within this time will result in an assets recovery procedure being activated. If attempts by the toy library to contact you are repeatedly ignored legal action may be taken against you to retrieve the toy library’s property.

If at any time you wish to cancel your toy library membership a termination form must be completed and signed. Once all toys are returned and any fines paid your security fee will be returned by bank transfer to your nominated account.

If your personal details or circumstance change you must advise the toy library immediately.

Child Safe Policy and Statement of Commitment

Our commitment to child safety

Our organisation is committed to child safety.

We want children to be safe, happy, and empowered. We support and respect all children, as well as volunteers and members.

Our staff and volunteers

This policy guides our volunteers and members on how to behave with children in our organisation.

Children should never be left unsupervised in the care of Toy Library volunteers.

Parents/guardians should always supervise their children at the Toy Library.

The ‘two-person rule’ will be followed – ensuring there are two people present when the toy library is open.

All our volunteers must agree to abide by our code of conduct, which specifies the standards of conduct required when working with children.

Our organisational culture aims for members and volunteers to feel confident and comfortable in the Toy Library.

Training and supervision

The Toy Library aims for all volunteers, members and children to feel confident and comfortable to participate in the library and to bring up any concerns regarding any topic or incident when necessary. The committee is always accessible through social media and email.

Risk management

The Toy Library is required to protect children ensuing the general occupational health and safety is of a high standard and that all safety risks are dealt with immediately. No child will be placed on our social media without permission from the primary parent. No image will be used unless provided by primary parent and deemed suitable for use by social media officers.

Regular review

This policy will be reviewed every two years and following significant incidents if they occur. We will ensure that families and children can contribute to the review. Where possible we do our best to work with local Aboriginal communities, culturally and/or linguistically diverse communities and people with a disability.

Allegations, concerns, and complaints

We work to ensure all families, members and volunteers know what to do and who to tell if they notice inappropriate behaviour towards another or feel unsafe in the library.

Swan View Toy Library - Code of Conduct

All members, volunteers and committee members are to observe child safe principles and display appropriate behaviours towards all children in the Toy Library.

All members, volunteers and committee members are responsible for supporting the safety, participation, wellbeing and empowerment of children by:

always adhering to our child safe policy and upholding our statement of commitment to child safety at all
treating everyone with
promoting positive participation and empowerment of children with culturally and/or linguistically diverse backgrounds (for example, by having a zero tolerance of discrimination).
promoting the safety, participation, and empowerment of children with a
promoting inclusivity for children with sensory needs.

Staff and volunteers must not:

use inappropriate language in the presence of
express personal views on cultures, race or sexuality in the presence of
discriminate against any child, including because of culture, race, ethnicity or disability.
